Legislative Frameworks for Mediators

Course aim

To introduce students to the law relating to domestic relationships, the family and the workplace.

Course content

Legislation and its application to marriage and dissolution of marriage in Australia; legislation and its application to the workplace and conflicts between employees and management; the role of the Family Court, the Industrial Commission, other legal entities and Unions. Defacto relationships. The effects of marriage and defacto relationships on rights to property, income maintenance and children’s matters. Rights of children: child abuse; removal of children from parental custody. Rights of employees and employers. Domestic violence and workplace harassment: powers of restraint; criminal and civil liability. The interaction between mediation processes, other alternative dispute resolution approaches, litigation and legislative frameworks as they relate to marriage dissolution and workplace conflicts.
