This course will cover key aspects of Australian common law and statutory provisions related to personal and real property. Its primary objective is to familiarise students with essential property interests and equip them with the skills to apply relevant laws and concepts in real-world scenarios involving property disputes. The course will concentrate on current issues affecting Australian property law, encouraging students to understand and actively engage with these topics.
Topics to be explored in this course include: Property law’s role in contemporary Australia; selected aspects of personal property law; bridging personal and real property law through the doctrine of fixtures; the relationship between equity and property; the Torrens system of land registration; leases and tenancies; community of ownership; rights and limits to land use; and Indigenous Land Rights and Native Title.
Finally, the course will explore developing issues in contemporary property law.
Students will also further develop their legal problem-solving skills. Students will gather, assess, and combine information from relevant case law, statute law and secondary sources to resolve competing interests in property law disputes and effectively communicate the results.
