Children and the Legal Process

Course aim

To develop students’ skills in analysing legislation, policies and practices pertaining to children in the legal system in Australia.

Course content

History of approaches to children and children’s rights; legislation, policies and procedures affecting children in Australia; theories of child development; the impact of disability, abuse and trauma on children; communicating with children; children at risk in the legal system, juvenile justice system, education system, and the care and protection system; the impact of cultural diversity on children’s involvement in the legal system; children from indigenous communities; direct and indirect strategies for including children and/or their interests in decision making including separate representation, advocacy and the inclusion of children in conciliation, mediation and other processes.
