Defence industry companies may respond to requests for the provision of equipment and systems from the Defence Materiel Organisation and other companies. If their response is favourably received they will subsequently engage in contract negotiations and contract execution.
Alternatively, companies may call for tenders for the supply of goods and services from other organisations and subsequently negotiate and execute a contract.
The aim of this course is to provide senior technical officers with the knowledge and skills to participate in an informed manner in the tendering and contracting processes of a defence industry company.
The Defence Procurement Manual: the legal framework for Commonwealth procurement and Commonwealth procurement guidelines.
The types of Commonwealth procurement - simple, complex and strategic.
Basic contract law including elements of a contract and types of contract. Standard defence contracting templates.
Typical structure of a request for tender including typical documentation.
The DMO approach to risk management. Earned value management.
The DMO approach to quality assurance, intellectual property, defence security requirements, and other relevant DMO interacting policies.
Forms of partnering and teaming arrangements.
The DoD capability life cycle. DoD approach to defining the requirement.
DMO methods of procurement and contracting methodologies.
Tender advertising, submission and receipt.
The process of developing and submitting a response to a Request for Tender.
Pricing and estimating.
Evaluating tenders. The processes of contract negotiation and contract formation.
Contract management role. Contract performance management.
Processes and legal basis of delivery, acceptance, payment and ownership.
Contractual remedies and the exercise of those remedies. Contractual rights and obligations.
The contract amendment process. Contract renewal or extension.
Methods of dispute resolution and alternative dispute resolution processes.
