Law and Land

Course aim

To develop an understanding of the Aboriginal relationship to law and land and the impact colonialism has had upon those relationships.

Course content

Aboriginal laws and their underlying philosophy; different relationships and world views that Aboriginal and non-Aboriginal peoples have to the land; key concepts in Australian property law and its recognition of Aboriginal relationships to country; Aboriginal law ways will be examined in the context of contemporary discussions on the recognition or otherwise of Aboriginal law by the Australian legal system; case study analysis of Aboriginal heritage and cultural issues and local case studies; comparative analysis of international law and the position of Aboriginal legal systems will be examined and particular focus will be given to the recent international debate on ownership and control of Aboriginal knowledge and land.
