Mediation Theory and Practice

Course aim

To advance students’ knowledge of theoretical concepts and skills underlying a range of approaches to mediation in a variety of settings.

Course content

Students will develop advanced knowledge of conflict theory, competition and cooperation, conflict handling styles, principled and positional negotiation, dispute resolution processes, the mediator role, the legal and cultural context of mediation, the characteristics and functions of a mediator; pre-mediation and selective screening; third party impartiality and neutrality.

Students will develop specialised cognitive skills to analyse the strengths and limitations of mediation, power, abuses of power and empowerment, the relationship between advocacy, mediation and therapy and between language, culture, gender and mediation.

Students will develop skills in the mediation process, analysing conflict, framing issues, generating options, designing intervention strategies to promote cooperation, resolving impasses, assisting negotiation, achieving fair outcomes, writing agreements, conflict coaching and managing ethical issues and standards.
