Course aim

To provide students with the opportunity to apply expert, specialised cognitive and technical skills in a body of knowledge to compile and assess construction claims and avoid and resolve disputes through various dispute avoidance procedures and dispute resolution methods.

Course content

Types of construction claims in law of contract, tort and equity. Remedies available for contract claims including damages, quantum merit and equitable orders. Assessing quantum of damages for construction claims. Dispute resolution clauses in standard forms of construction contract. Construction litigation and arbitration. Alternative dispute resolution methods including mediation and expert determination. Statutory construction adjudication. Dispute avoidance procedures.
