Transnational Commercial Transactions Law

Course aim

To provide students with an understanding of the areas of commercial law which have an impact on business at the international level. This will be done by focusing upon a number of key areas of law which are triggered by international commerce. The subject will adopt a transactional approach in discussing these areas of law.

Course content

[1] An Introduction to Transnational Law Theory and Transnational Commercial law
[2] Harmonization of Laws in International Commercial Transactions.
[3] Concepts in the international sale of goods.
[4] Contracts of sale under the Vienna Sales Convention.
[5] Contracts for the carriage of goods by sea, air and land.
[6] Payment in international commercial transactions.
[7] Financing of international commerce and legal issues in foreign investment.
[8] Cross-border Insolvency.
[9] Legal issues of intellectual property rights and electronic commerce in an international context.
[10] Settlement of international commercial disputes: litigation and conflict of laws; international arbitration; negotiation; mediation.
