Course aim

The aim of this course is to provide students with advanced understanding of the law of succession in Australia.

Course content

This course covers:

1. The scope and meaning of succession law.
2. The nature of a will.
3. The requirements for making, executing, revoking and altering a will.
4. How wills are construed and interpreted by the courts.
5. The effects of gifts made by will.
6. Intestacy and the distribution of assets.
7. Restrictions imposed on freedom of testation; Family Provision.
8. The appointment of Executors and Administrators.
9. The duties and powers of personal representatives in administering deceased estates.
