International and Comparative Environmental Law

Course aim

• To examine the role of international environmental law in addressing the global dimensions of environmental protection
• to compare distinctive approaches to the implementation of international environmental law at the domestic level
• to analyse the link between poverty and environmental harm and the role of law in promoting environmental sustainability

Course content

• the principal sources of international environmental law
• the link between poverty and environmental harm and the special needs of developing countries
• the concept of environmental sustainability and its reflection in specific legal principles (precaution, inter and intra-generational equity, polluter pays)
• the role of international institutions in global environmental governance
• the challenge in securing compliance and enforcement of multilateral environmental agreements
• the nature of comparative legal research and its relevance to environmental law
• selected issues in international environmental law and a comparative analysis of their treatment in selected national jurisdictions (climate change and atmospheric pollution; biodiversity protection; deforestation; human rights and the environment; and international financial mechanisms)
