Course aim

This course aims to build upon the knowledge, understanding and skills developed in Torts A through a more in-depth examination of a wider range of torts and related issues. It also aims to equip students with a more detailed and sophisticated knowledge and understanding of how this area of the law is likely to develop in the 21st Century. Integral to this aim is the ability to apply the knowledge and understanding of the law to analysing real life torts case studies.

Course content

Torts B develops student’s knowledge and understanding of tort law and its purpose and their skills in problem solving, case analysis and communication in the legal context.
The material covered in this course includes;

1. Negligence – Duty of care in novel fact situations, e.g. public authorities, nervous shock, pure economic loss and misrepresentation. A comparison of the Competition and Consumer Act 2010(Cwth).
2. Breach of Statutory Duty
3. Vicarious liability
4. Non-delegable Duties
5. Assessment of Damages in Personal Injury Actions
6. Defamation
7. Private Nuisance.
